The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice: "Client", “You” and “Your” refers to you, the person accessing this website and accepting the Company’s Terms and Conditions. "The Company", “Ourselves”, “We” and "Us", refers to GardensOnline Shopping Pty Ltd. The “site” or “website” refers to GardensOnline.com.au.

All terms refer to both the shopping process and any general information provided on the website. Any use of the above terminology or other words in the singular, plural, capitalisation and/or he/she or they, are taken as interchangeable and therefore as referring to the same.

We are committed to protecting your privacy. Information collected from you is used to fulfill your order and/or for Frequent Flower Club members to receive special offers. We do not sell, trade or rent your personal information to any third party.

We will only send emails in connection with the provision of agreed services and products.

Statistical Website Traffic Analysis

We use IP addresses to analyse trends, administer the site, track user’s movement, and gather broad demographic information for aggregate use. IP addresses are not linked to personally identifiable information. Additionally, for systems administration, detecting usage patterns and troubleshooting purposes, our web servers automatically log standard access information including browser type, access times/open mail, URL requested, and referral URL. This information is not shared with third parties and is used only within this Company on a need-to-know basis. Any individually identifiable information related to this data will never be used in any way different to that stated above without your explicit permission.

Unsolicited Images

We are unable to accept images from third parties that are confidential or proprietary. If you do not wish your image to be used on the site please do not send it to us.

Any unsolicited images submitted to GardensOnline become the property of GardensOnline for use within the website without any obligation to compensate the supplier. This will apply even if the photo comes with a statement as to confidentiality contrary to these terms of use.

The Shopping Process

Prices and GST

All prices quoted on the website are in Australian dollars A$ and include GST

Payment

Items can be purchased using Credit Cards (MasterCard and Visa), PayPal or by Cheque.

Orders will only be dispatched once payment has been received and authorised.

Reimbursement / Refunds

Refunds for damaged goods, goods lost in transit or out of stock will be made in full to the original payment method e.g. credit card or PayPal.

Refund requests for goods purchased but not yet despatched due to change of mind or error in making multiple purchases will incur transaction cancellation fees (detailed below).

If on receipt of goods the customer changes their mind and requests to return the goods for a refund then the customer will be responsible for postage or courier costs and ensuring the goods arrive at GardensOnline in a saleable condition. At this point a refund will be made less the refund cancellation fees.

Refunds incur the transaction fees of the original payment method plus GardensOnline refund fees:-

  • Credit Cards - 1.3% of original transaction
  • PayPal 2.26% of original transaction + $0.30 per transaction
  • plus GardensOnline refund administration fee of $4.50 per transaction.

We are only able to reimburse the credit card that was used in the initial transaction.

Delivery Details

It is your responsibility to ensure that all your delivery details have been entered correctly. We cannot be held responsible for entry of unclear or incorrect delivery information. You will be responsible for any subsequent redelivery costs.

Cancellation Policy

Orders cancelled giving sufficient time for the shipment to be stopped will be credited to the credit card used in the initial purchase or the cheque refunded less cancellation fees.

Returned or damaged goods

We guarantee to replace, exchange or refund any goods that are delivered to you damaged or faulty. This guarantee requires you to inform us immediately of the problem along with provision of a photograph showing the damage. Shipping costs for returned goods are the responsibility of the supplier.

Incorrectly described goods

We guarantee to exchange or refund any goods that do not match the description on our website. This guarantee requires you to inform us immediately of the problem. Shipping costs for returned goods are the responsibility of the supplier.

Goods that cannot be returned

Products that have been used or products that are unused but you have subsequently decided you don’t want, cannot be returned.

Product Warranties

All non-live products that we sell are covered by the manufacturer's warranty. Once the goods have been supplied in a satisfactory condition, the manufacturer's warranties and guarantees apply. Any problems with the product should then be taken up with the manufacturer.
